These Terms and Conditions ("Terms") govern your access to and use of the Hyrexia website, applications, and related services (collectively, the "Service") operated by Hyrexia ("we," "us," or "our"). By creating an account, accessing the Service, or accepting these Terms, you agree to be bound by them. If you do not agree, do not use the Service.
These Terms apply to users outside Canada. If you are located in Canada, please read our Terms and Conditions (Canada). These Terms are provided for general information and do not constitute legal advice in your jurisdiction.
1. Definitions
- Account — your registered candidate profile on the Service.
- Content — information you submit or generate through the Service, including resumes, interview responses, transcripts, recordings, and evaluations.
- Interview Session — a mock interview conducted through the Service, which may include live audio, video (where enabled), AI interaction, transcripts, and recordings.
- Personal Data — information relating to an identified or identifiable individual, including "personal information," "personal data," or similar terms under applicable law (such as the EU/UK GDPR, U.S. state privacy laws, or other local privacy regimes).
2. Eligibility
You must be at least 18 years old, or the minimum age required in your country to enter into a binding contract (if higher), to use the Service. Where local law requires parental or guardian consent for minors, you represent that such consent has been obtained. All registration information you provide must be accurate and current.
3. Accounts and security
You are responsible for safeguarding your credentials and for activity under your Account. Notify us promptly via Contact us if you suspect unauthorized access. We may suspend or terminate Accounts that violate these Terms or create risk for the Service or other users.
4. The Service
Hyrexia provides AI-assisted mock interview preparation, including resume-aware planning, real-time voice interviews, automated evaluations, optional playback, and premium features (such as personalized recommendations and better-answer guidance). The Service is for practice and self-development only. It does not provide employment, immigration, legal, medical, or other professional advice, and we do not guarantee hiring outcomes.
AI outputs may be inaccurate or incomplete. You are solely responsible for decisions you make based on the Service.
5. Consent to recording and monitoring
By starting or participating in an Interview Session, you expressly consent to the capture, recording, storage, processing, transcription, and analysis of your audio, video (where enabled), session metadata, and related Content as necessary to operate the Service.
- Recordings and transcripts are used to provide playback, AI evaluation, billing, security, support, and product improvement.
- Recording laws differ worldwide (including one-party and all-party consent rules). You are responsible for obtaining any consents required in your location before recording yourself or others, and for using the Service in an appropriate private setting.
- Do not use the Service to unlawfully surveil or record third parties without permission.
- Ending a session stops further capture; content already collected remains subject to retention described below.
6. Personal data, storage, and privacy
We process Personal Data as a controller (or equivalent under local law) for the purposes described in these Terms. Where required, we rely on lawful bases such as contract performance, legitimate interests (operating and improving the Service), consent (where applicable, including recording and certain marketing), and legal obligation.
6.1 Categories of data
- Account data (e.g., name, email, authentication identifiers).
- Uploaded resumes and derived parse or AI analysis data.
- Interview data: transcripts, scores, evaluations, recommendations, and audio/video recordings.
- Payment and wallet records (processed via third-party payment providers such as Stripe).
- Support messages and technical logs used for security and reliability.
6.2 International storage and transfers
Personal Data may be stored or processed in Canada, the United States, or other countries where we or our subprocessors operate. Where you are in the European Economic Area (EEA), United Kingdom, Switzerland, or another jurisdiction restricting cross-border transfers, we implement appropriate safeguards where required (such as Standard Contractual Clauses or equivalent mechanisms), in addition to technical and organizational security measures.
6.3 Retention
We retain Personal Data only as long as necessary for the purposes in these Terms or as required by law. Interview video recordings are kept for a limited period (by default, a few days after session completion, subject to change), after which video files are deleted from storage while transcripts, evaluations, and billing records may be retained longer where permitted.
6.4 Your privacy rights
Depending on your location, you may have rights to:
- Access, correct, delete, or port your Personal Data.
- Restrict or object to certain processing.
- Withdraw consent where processing is consent-based (without affecting prior lawful processing).
- Lodge a complaint with a supervisory authority (e.g., in the EEA/UK).
- Opt out of certain processing under U.S. state laws (e.g., targeted advertising or sale/sharing as defined locally), where applicable.

6.5 Subprocessors
We use trusted providers for hosting, storage, real-time communications, AI processing, email, analytics, and payments. They process Personal Data on our instructions and subject to contractual confidentiality and security obligations.
7. Artificial intelligence
The Service uses automated and AI systems to conduct interviews, parse resumes, and generate feedback. Outputs are probabilistic and may be wrong or biased. Do not rely on AI outputs as your only basis for employment, legal, or other high-stakes decisions. Where local law grants rights related to automated decision-making, you may contact us to learn more about how evaluations are produced.
8. Credits, billing, and refunds
Paid features use prepaid credits or one-time unlocks shown before purchase. Payments are handled by third-party processors. Refund rights depend on mandatory consumer laws in your country; otherwise, fees are generally non-refundable once credits or unlocks are delivered, except where we agree otherwise in writing.
9. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights.
- Upload unlawful, infringing, or harmful content.
- Probe, disrupt, or circumvent Service security or usage limits.
- Impersonate others or provide false registration information.
- Submit special-category or highly sensitive data without lawful basis and appropriate safeguards (e.g., health data of others without authorization).
10. Intellectual property
We own the Service, software, and branding, subject to third-party rights. You retain ownership of Content you submit and grant us a worldwide, non-exclusive, royalty-free licence to use, host, reproduce, adapt, and display Content solely to operate, secure, and improve the Service as described in these Terms.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow exclusion of certain warranties; in those cases, our liability is limited to the fullest extent permitted by law.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYREXIA AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $100 (OR LOCAL CURRENCY EQUIVALENT), EXCEPT WHERE LIABILITY CANNOT BE LIMITED (INCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR STATUTORY CONSUMER RIGHTS).
Nothing in these Terms limits rights you have under mandatory consumer protection or data protection laws in your country of residence.
13. Indemnity
You will indemnify and hold Hyrexia harmless from claims, losses, and reasonable expenses (including legal fees) arising from your Content, misuse of the Service, or breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for breach, legal compliance, or protection of users and infrastructure. Provisions that should survive termination (including intellectual property, disclaimers, liability limits, indemnity, and governing law) remain in effect.
15. Changes to these Terms
We may update these Terms by posting a revised version with a new effective date. Material changes may be notified through the Service or email where appropriate. Continued use after the effective date constitutes acceptance, unless your local law requires otherwise.
16. Governing law and disputes
These Terms are governed by the federal laws of Canada and the laws of the Province of British Columbia, without regard to conflict-of-law principles that would refer another jurisdiction's laws, except where mandatory local law in your country of residence requires otherwise.
Subject to non-waivable consumer rights, you agree that courts in British Columbia, Canada have exclusive jurisdiction over disputes, unless applicable law in the EEA, UK, or certain other regions requires disputes to be heard in your country of residence.
If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform. We are not obliged to participate in alternative dispute resolution procedures where not required by law.
