These Terms and Conditions ("Terms") govern your access to and use of the Hyrexia website, applications, and related services (collectively, the "Service") operated by Hyrexia ("we," "us," or "our"). By creating an account, accessing the Service, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Service.
These Terms apply to users in Canada. If you are located outside Canada, please read our Terms and Conditions (International). These Terms are provided for general information and do not constitute legal advice.
1. Definitions
- Account — your registered candidate profile on the Service.
- Content — information you submit or generate through the Service, including resumes, interview responses, transcripts, recordings, and feedback.
- Interview Session — a mock interview conducted through the Service, which may include live audio, video, AI interaction, transcripts, and evaluations.
- Personal Information — information about an identifiable individual, as defined under applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and substantially similar provincial legislation where applicable.
2. Eligibility
You must be at least the age of majority in your province or territory of residence (18 or 19 years old, depending on jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that all registration information you provide is accurate and current.
3. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account. Notify us promptly through Contact us if you suspect unauthorized access. We may suspend or terminate Accounts that violate these Terms or pose a security risk.
4. The Service
Hyrexia provides AI-assisted mock interview preparation, including resume-aware question planning, real-time voice interviews, automated evaluations, optional playback, and premium coaching features (such as better-answer guidance). The Service is for practice and self-improvement only. It does not constitute employment, recruiting, or professional advice, and we do not guarantee interview outcomes or hiring results.
AI-generated content may be incomplete, inaccurate, or inappropriate for your specific situation. You are responsible for how you use outputs from the Service.
5. Consent to recording and monitoring
By starting or participating in an Interview Session, you expressly consent to the capture, recording, storage, processing, and review of your audio, video (where enabled), screen or session metadata, and related transcripts as necessary to operate the Service.
- Recordings and transcripts are used to provide playback, AI evaluation, billing where applicable, troubleshooting, and product improvement.
- You represent that you will not record third parties without their lawful consent where required by Canadian law, and that you will use the Service in a private setting when practicable.
- Laws governing the recording of conversations vary by province and territory. You are responsible for compliance with local requirements when using the Service.
- You may stop recording by ending the session; however, content already captured may remain subject to retention described below.
6. Personal information, storage, and privacy (Canada)
We collect, use, and disclose Personal Information in accordance with Canadian privacy principles, including accountability, identifying purposes, consent, limiting collection, limiting use and disclosure, accuracy, safeguards, openness, individual access, and challenging compliance, as reflected in PIPEDA and applicable provincial privacy statutes (including Quebec's private-sector privacy regime where relevant).
6.1 What we collect
- Account and profile information (e.g., name, email, authentication data).
- Resumes and files you upload (e.g., PDF, DOCX) and derived parsed or AI analysis data.
- Interview Session data: transcripts, scores, evaluations, hiring-style recommendations, and audio/video recordings.
- Billing and wallet transaction records (e.g., credit purchases via Stripe).
- Support communications and limited technical logs needed to secure and operate the Service.
6.2 How we use information
- To deliver, personalize, and improve the Service.
- To run AI features (e.g., interviewers, evaluators, resume analysis) via our infrastructure and subprocessors.
- To process payments, prevent fraud, and comply with law.
- To respond to support requests and enforce these Terms.
6.3 Storage and location
Content may be stored on servers operated by us or trusted providers (including cloud storage and AI/voice providers). Data may be processed or stored in Canada or other jurisdictions where our providers operate. Where Personal Information is transferred outside Canada, we take reasonable steps to require comparable protection by contract or law, consistent with applicable requirements.
6.4 Retention
We retain Personal Information only as long as needed for the purposes described in these Terms or as required by law. Interview video recordings are subject to a limited retention period (by default, a few days after session completion, configurable by us), after which video files are removed from storage while related transcripts, evaluations, and billing records may be kept longer where permitted and necessary.
6.5 Your rights
Subject to applicable law, you may request access to, correction of, or deletion of your Personal Information, or withdraw consent where processing is consent-based. Certain withdrawals may limit your ability to use the Service. Contact us at Contact us to make a privacy request. You may also have the right to complain to the Office of the Privacy Commissioner of Canada or your provincial privacy regulator.
6.6 Subprocessors
We use third-party services to operate the Service, which may process Personal Information on our behalf, including providers for authentication, hosting, object storage, real-time communications, AI models, email delivery, and payment processing (e.g., Stripe). Their use of data is governed by their terms and our agreements with them.
7. Artificial intelligence
The Service uses automated systems, including large language and speech models, to conduct interviews, analyze resumes, and generate evaluations. Outputs are probabilistic and may contain errors. Do not rely on AI outputs as sole basis for employment, legal, medical, or financial decisions.
8. Credits, billing, and refunds
Certain features require prepaid credits or paid unlocks. Prices and credit consumption are displayed before purchase. Payments are processed by third-party payment providers. Unless required by applicable consumer protection law, fees are non-refundable once credits are delivered or premium features are unlocked, except where we expressly agree otherwise in writing.
9. Acceptable use
You agree not to:
- Use the Service for unlawful, harassing, defamatory, or discriminatory purposes.
- Upload malware, infringing content, or information you lack rights to share.
- Attempt to bypass security, scrape the Service, or interfere with other users.
- Misrepresent your identity or impersonate another person.
- Use the Service to process highly sensitive data you are not authorized to share (e.g., others' health records without consent).
10. Intellectual property
We own the Service, branding, software, and underlying technology, subject to third-party rights. You retain ownership of Content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, modify, and display your Content solely to operate, secure, and improve the Service and as described in these Terms.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYREXIA AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING CERTAIN CONSUMER PROTECTION STATUTES).
13. Indemnity
You will defend and indemnify Hyrexia against claims, damages, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
15. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Material changes may be communicated through the Service or by email where appropriate. Continued use after changes take effect constitutes acceptance of the revised Terms.
16. Governing law and disputes
These Terms are governed by the federal laws of Canada and the laws of the Province of British Columbia, without regard to conflict-of-law rules that would apply another jurisdiction's laws. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for disputes arising from these Terms or the Service, except where applicable consumer protection legislation in your province or territory grants you non-waivable rights to bring proceedings in your place of residence.
